Free School Meals
Free Meal Entitlement Criteria
Free School Meals is a benefit awarded in respect of statutory
school age children in full time education where the parent or
guardian is in receipt of one of the benefits shown below:
- Income Support;
- Income Based Jobseekers Allowance (IB JSA);
- Support under part VI of the Immigration and Asylum Act
1999;
- Child Tax Credit, provided they are not entitled to Working Tax
Credit and have an annual income, as assessed by the Inland Revenue
that does not exceed £15,575 from 6th April
2008.
- The Guaranteed Element of State Pension Credit.
- Employment Support Allowance (ESA(IR))
NB. Children in receipt of Income Support and Income Based
Jobseekers Allowance (IBJSA) in their own right are also entitled
to free school meals.
From 5 December 2005, the Civil Partnership Act came into force,
giving legal recognition to same sex couples. For Free School Meals
eligibility purposes, this means that same sex couples who live
together and who are claiming the above listed income-related
benefits can claim free school meals for their dependant
children.
By Law no other category of support payment or combination of
Tax Credits qualify for free school meals. Similarly, there are no
other circumstances that can legally justify the provision of a
free meal.
Proof of income is not required at this time.
Money received each week through Working Tax Credit benefit
includes an amount for Free School Meals. This means that you do
not qualify for a free meal if you receive it.
