Offences

Depositing Litter

Refers to litter being deposited/discarded on land or water in the open air that is accessible to the public.

Failure to comply with street litter control notices

These notices are designed to be served on commercial premises and in particular food premises whereby there is an accumulation of litter in the vicinity as a result of the operation of the business. The notice would stipulate that the proprietor would have a duty to ensure that a specified distance either side of the 'frontage' of the premises is kept clear of litter.

Failure to comply with a litter clearing notice

Principal litter authorities have the power to issue these notices where land in their area is defaced by litter. Applies to private land and if the notice is not complied with the local authority would be empowered to enter the land, clear the waste and recover the costs.

Failure to produce waste documents

Local authority has the power to demand (via a notice) confirmation on how a commercial enterprise disposes of its trade waste; non-compliance of this notice is it self an offence and it usually encourages traders to ensure their waste is disposed of in the correct manner.

Failure to produce authority to transport waste

Anyone who transports waste for gain or in the course of their business activities should be licensed to do so. Authorised officers of the Council have the power to request to view these licenses.

Failure to comply with a waste receptacle notice

These notices would be served on householders and traders to ensure that their waste is presented at the right time and in the right place; also deals with any excess waste that may be presented by traders.

Dog Fouling Fixed Penalty notice

Failure to clean up after a dog that you own or are in charge of will result in a fixed penalty fine.

Leaving two or more vehicles on the road for sale

This is designed to target people who run a business selling motor vehicles who use the highway as a mock showroom. This behaviour is unfair to local residents who are subsequently deprived of using the road themselves to park and go about their daily lives.

Abandonment of vehicle

The Council has the responsibility to remove all vehicles that have been abandoned on land in the open air.
