Highways Act 1980

The Highways Act 1980 is a law in the UK that deals with roads in England and Wales. It addresses how to manage and take care of roads, including drainage, to stop flooding.

Our responsibilities:

  • Duty to maintain - we must keep the roads clear and ensure suitable drainage.
  • Drainage works - we can construct and maintain drainage systems to prevent highway flooding.
  • Liability for damage - we are liable for damages on its highways, caused by poor drainage.
  • Enforcement - The Act outlines procedures for enforcement action. We can recover costs from responsible parties, for maintenance and repairs.
